Bharatiya Nyaya Sanhita, 2023
Bharatiya Nyaya Sanhita, 2023
✅ What is BNS 2023
-
It is an Act of Parliament titled “The Bharatiya Nyaya Sanhita, 2023”, Act No. 45 of 2023.
-
It replaces the previous criminal law code, the Indian Penal Code, 1860 (IPC) in India.
-
The law received the President’s assent on 25 December 2023.
-
Its provisions came into effect from 1 July 2024 (unless specified otherwise) for implementation.
🧐 Key features and changes
- Structure: The BNS condenses the earlier code; it has 358 sections compared to the IPC’s 511 (approx) by reorganising and merging similar offences.
- Definitions: It consolidates definitions in a clearer way (eg. “act”, “child”, “animal”) under one section (Section 2) rather than scattered definitions.
- New offences & updates:
- Introduces or clarifies offences such as organised crime, terrorism, cyber-fraud, environmental offences.
- Removes or changes some older offences (for example, sedition as it was under IPC).
- Punishments & sentencing:
- Includes community service as a possible punishment for certain offences.
- Adjusts penalties (higher fines, longer sentences) in many places.
- Aims/Objective: The Act’s purpose is “to consolidate and amend the provisions relating to offences and for matters connected therewith or incidental thereto.”
🎯 Why it matters
Because India’s earlier penal code (IPC) dates back to 1860 and was a colonial-era statute, the new BNS is seen as a major reform to bring criminal law in line with contemporary needs — technology (cybercrime), organised crime, different societal structures etc.
Also, for anyone studying law, governance, or preparing for public service exams, this is a critical update.
